COMMISSION BUSINESS <br /> <br />Case #1: Establishment of Primary Election System <br /> <br />City Attorney Goodrich noted for informational purposes only that at the Charter Commission <br />meeting on June 7, 2001, the Commission voted to recommend that Chapter 4 of the City Code <br />be amended to provide for a primary election system. That motion was contingent upon the ward <br />system also being presented for consideration. The Commission was presented the final version <br />of the primary election Charter Amendment text. <br /> <br />Case #2: Consider Establishment of Ward System <br /> <br />Chairperson Vogt stated that at the Charter Commission meetkng on June 7, 2001, the <br />Commission further considered establishing a ward system for election of Councilmembers. The <br />discussion centered on a ward system not requiring the Council majority to be elected every two <br />years. That provision was the text printed on blue paper and dated May 24, 2001. The City <br />Attorney suggested amending line 3 by insertion of the phrase "...elected from a ward..." and <br />deleting "...for which elected..." The Commission voted to delete line 10. The City Attorney <br />suggested that line 10 read simply: "The Wards shall be designated as Ward Numbers 1, 2, 3, <br />and 4." Staff presented the Commission with a draft showing the referenced amendments to <br />lines 1 through i 0 to date. <br /> <br />City Attorney Goodrich noted that he had determined since the last Charter Commission meeting <br />that turning over the majority of the Council is not possible under State Statute, unless the Mayor <br />serves a two-year term. State Statute permits a Mayors term to be either a two or four year term, <br />but a Councilmembers term can only be a four-year term. <br /> <br />Commissioner Swanson inquired if they could have two year terms during the transition period. <br /> <br />City Attorney Goodrich replied 'yes. <br /> <br />Commissioner Henke inquired if it was State Statute or the City Charter that required <br />Councilmembers to serve a four-year term. <br /> <br />City Attorney Goodrich replied that it was State Statute, which overrides the City Charter. <br /> <br />Commissioner Henke inquired as to what Statute placed such a requirement. <br /> <br />City Attorney Goodrich replied State Statue MN 205.07 sub 1 under Date of Election section. <br /> <br />Chairperson Vogt requested that the Commission approve the wording changes for Section 2.3 <br />Council Composition and Etection numbers I through 10: <br /> <br />Charter Commission/July 19, 2001 <br /> Page 2 of 5 <br /> <br /> <br />
