-282- SUNFISH PROPERTIES DEVELOPMENT AGREEMENT CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA THIs AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and SUNFISH PROPERTIES, LLC, whose address is 10734 Hanson Blvd., Coon Rapids, MN 55433 (the "DEVELOPER"). WITNESSETH: WHEREAS, the DEVELOPER is the fee owners of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: Lot 11, Auditor's Subdivision No. 30, Anoka County, Minnesota, EXCEPT the following described parcels: All that part of Parcel lA of the Anoka County Highway Right of Way Plat No. 1 contained within said Lot 11; All that part of Lot 11, Auditor's Subdivision No. 30, lying east of Parcel lA of Anoka County Highway Right of Way Plat No. 1; All that part of east half of Government Lot 4, Section 34, Township 32, Range 25, Anoka County, Minnesota lying southerly of southerly right of way line of Burlington Northern Railroad and lying northerly of northerly right of way line of U.S. Highway 10, except that part thereof lying west of following described line: Commencing at intersection of west line of said east half of Government Lot 4 with said southerly right of way line of said Burlington Northern Railroad thence southeasterly along said railroad right of way line 75.12 feet to point of beginning of said line, thence southerly 427.52 feet more or less, to intersect and terminate at a point on said northerly right of way line of said Highway #10 68.87 feet, as I I I I I I i I I I I I I I I I I I I
