I I I I I I I I I I I I I I I I I I d. The City has received signed Development Agreements with required financial sureties in place. Subd. 6. Application Fees and Escrows. At the time of submis~, 9.50.02 sketch plan, the subdivider shall pay a fee and deposit a fee into an escrow account as demrmmea from time to time by Council ordinance. The escrow is applied to costs incurred by the city in employing the services of the City Staff, attorneys and other professional consultants in connection with the review of said sketch plan. However, the said deposit may also be used to reimburse the city for the expense of employing the services of the city engineer, attorneys and other professional consultants in connection with the review of the preliminary plat and final plat as prescribed in this Chapter. If said escrow is not sufficient to defray' the above expenses, additional monies will be required prior to final action on the plat, and if, in the opinion of the Zoning Administrator, the deposit is depleted such that it is unlikely to be sufficient to meet the remaining anticipated expenses, the subdivider shall be required to deposit an amount sufficient to bring the account to a positive balance of, prior to any further action on the plat. If after final action on the proposed subdivision, a surplus balance remains in the city's accounts, said surplus balance shall be refunded to the subdivider. The said deposit shall be in addition to the. fe.e.q prescribed elsewhere in this Chapter. 9.50.02 9.50.02 Major Plat Subdivision 1. Sketch Plan. Prior to dividing any tract of land, the subdivider shall submit a sketch plan for review by the planning commission. At the time of submission of the sketch plan, the subdivider of the land covered by the sketch plan shall submit a petition for rezoning to the proposed use of said land, if the land is not already so zoned. The owner of said land shall join in said petition. The subdivider shall file sufficient copies of the sketch plan with the Zoning Administrator at least thirty (30) calendar days before the next regular monthly meeting of the planning commission at which meeting said sketch ptan shall be considered. The Zoning Administrator shall distribute the copies of the sketch plan to the appropriate individuals, applicable agencies and notifications to property owners located within seven hundred (700) feet of the property The City Engineer and Zoning Administrator shall submit their reports to the Council and shall state whether the sketch plan and the improvements conform to the engineering and design standards and City Code requirements. do The planning commission shall consider the sketch plan, the. City Staff review letter(s) and any other pertinent information which they may wish to consider. The planning commission shall advise the subdivider of the extent to which the plan conforms to the requirements of the community and the 9.50 Subdivision Regulations 9-5 March 2003 Draft -383-
