-404- <br /> <br /> Subd. 2. Hardship. In any case in which compliance with the foregoing <br />restrictions will create an unnecessary hardship and failure to comply does not interfere with the <br />purpose of this Chapter, the Council may waive such compliance by adoption of a resolution to <br />that effect and the conveyance may then be filed or recorded. <br /> <br /> Subd. 3. Civil Penalty. Any owner or agent of the owner of land who <br />conveys a lot or parcel in violation of the provisions of this Section shall forfeit and pay to the <br />City a penalty as prescribed. The City may enjoin such conveyance or may recover such penalty <br />by a civil action in any court of competent jurisdiction. <br /> <br /> Subd. 4. Plats Previously Recorded. All preliminary or final plats, <br />registered land surveys or other subdivisions of land approved but not filed under previous <br />ordinances shall be subject to all requirements of this Chapter but will be reviewed separately on <br />their own merits. <br /> <br />9.50,10 <br /> <br />9.50.10 through 9.50.29 (reserved) <br /> <br />9.50.30 <br /> <br />Subdivision Design Standards <br /> <br /> Subdivision 1. General Requirements. The Plarming Commission in its <br />review of a preliminary plat shall determine whether the proposed Subdivision is in conformity <br />with the city code and shall take into consideration the requirements of the community and the <br />best use of the land. Particular attention shall be given to the arrangement, location and widths <br />of streets, drainage and lot sizes and arrangements. <br /> <br />Subd. 2. Street Plan <br /> <br />9.50.30 <br /> <br />The arrangement, character, extent, width, grade and location of all streets <br />shall conform to the approved standard street specifications and all <br />applicable sections of the Code. All streets shall be paved with concrete or <br />bituminous surfacing. <br /> <br />The arrangement of streets in new subdivisions shall connect to adjacent <br />street stubs and provide future street stubs to adjoining areas. <br /> <br />Subd. 3. Streets <br /> <br />a.
