-76- <br /> <br />City discussing the need for the extension to allow for the continuation of discussions for <br />developing the property. The facility has been receiving some product on the site. In regards to <br />the fence, Mr. Shot has indicated that if the fence is completed as required as part of the permit, it <br />might negatively impact the development of the property. The next communication they <br />received was a request by the City for additional time to act on the extension request so the <br />pennit was extended to July 17th. On June 25th he received a letter from the City stating that the <br />Planning Commission was conducting a public hearing on the issue on June 25tI' and that staff <br />was prepared to make a verbal recommendation. He contacted the City to inform them that Mr. <br />Shot was not able to attend nor was he. During that conversation he was told that staff was going <br />to be recommending denial of the extension. He did submit a letter to the City requesting that <br />the extension be granted for several reasons, which he reviewed. Prior to the Planning <br />Commission, that is the first anyone associated with St. Paul Terminals heard anything about the <br />area being a redevelopment area. Mr. Martinson stated that lie was present to request that the <br />Council disregard the denial recommendation by the Planning Commission out of fairness to the <br />property owner. <br /> <br />Councilmember Elvig inquired if the property was located in a TI:F District. <br /> <br />City Administrator Norman replied' yes. <br /> <br />Community Development Director Frolik noted that there were no TIF requirements included in <br />the conditional use permit. <br /> <br />Mayor Gamec questioned why St. Paul Terminals was not notified of the area being identified for <br />redevelopment. <br /> <br />Community Development Director Frolik explained that the EDA has only had general <br />discussions on the issue. <br /> <br />Mayor Gamec stated that it is an area the City has been trying to clean up for some time and' it <br />seems as if St. Paul Terminals has not followed through on some of their responsibilities. <br /> <br />Mr. Martinson stated that St. Paul Terminals is not in the real estate development business. They <br />are not opposed to redevelopment of the property and without the conditional use permit they <br />cannot operate as a recycling business so they are then working as real estate developers. <br /> <br />Mayor Gamec stated that there have been problems in the area for a long time and how long <br />should they allow that to happen. He inquired if the conditional use permit was extended would <br />the things be done as required by the permit. <br /> <br />Mr. Martinson replied that one of the reasons the fence has not been completed is becaUse if they <br />are able to expand their facility the fence would have to be removed. He did not believe that <br />there was a down side to the City if they were to extend the permit for a short term.
