Mr. Newcomb replied thai tabling action would only delay action when the majority of the residents want residential, Mayor Gamec stated that he thought that mixed use was the right designation for the area, but thought the Council should table action to discuss the issue further. Motion by Councilmember Elvig, seconded by Councilmember Pearson, to table action for further discussion at a work session. Further discussion: Councilmember Strommen stated that she wanted to make sure that the neighborhood was notified of the work session so that they kmow what the different options are. Motion carried. Voting Yes: Mayor Garnet, and Councilmembers Ely/g, Pearson, Cook, Kurak, Strommen, and Zinvnerman. Voting No: None. Case #14: Consider Entering into Agreement with MnDOT Relating to Intersection of Ramsey Boulevard and Highway gl0 City Engineer Jankowski stated that the City entered into an agreement with Tmxlemoon, Inc. for the development of Rivenwick 3r~ Addition. This subdivision required the connection of Pdverdale Drive to Highway 10 through the construction of Ramsey Boulevard, the fourth leg of the Ramsey,5-Iighway .!0 intersection. The colLfiguration of this intersection is presently uncertain due to the impact of the traffic generated from the Ramsey Town Center. The Development Agreement limits the number of units within the Pdvenwick 3r~ subdivision until the cmznection Ramsey Boulevard to Highway 10 becomes operational. The reconstruction of the Ramsey/Highway 10 intersection to include the additional lanes required for the Ramsey Town Center is cm'rently anticipated to take place in the near future. In order to construct the south leg phor to that time, MnDOT has agTeed to accept a temporary signal system at this intersection during the interim. The Council was presented with two agreements between the Ci9' and MrLDOT, which must be executed before this temporary signal will be allowed. The first document is Traffic Control Signal Agreement No. 85509R. Items 1 and 2 of this agreement w?rich require the preparation of plans and specifications have already been completed by the developer and have been approved by MnDOT. The second agreement is a Memorandum of Understanding, which identifies the responsibilities of the City and MnDOT relative to the permanent trafiic signals at this intersection. The City's agreement with the Pdvenwick 3rd Developer in lzis current development agreement is that he will pay the costs associated with the construction and si=mTalization of the P!ighway i0/Ramsey Boulevard intersection. A supplemental development a~m'eement with the Developer has been prepared. This supplemental agreement proposes to make .the obligations accepted by the City in these two Mn/DOT agreements. Motion by Councilmember Pearson, seconded by Councilmember Elvig, to authorize entering into the Memorandum of Understanding and signed agreement 855097R contingent upon Turtle -98- City Council/August 26, 2003 Page 20 of 25
