If ~ns~a~, <br />a stonr~ sewer system-may dischargeXinto the Sunfish Commons detention pond since it is <br />encumbered with an easement; however, the mobile home park must meet its own pending <br />requirements prior to discharge. The existing feasibility study addressed th/s element in only a <br />cursory fashion. The volume of the pending requirements needs to be determined as well as <br />pond location prior to proceeding with preparation of plans and specifications. Finally, there was <br />an issue regarding the cost of extending the sanitary ~ewer to the eastern property line of the <br />mobile home park through the Sunfish Commons development. The cost of this extension is <br />estimated to be $13,228. At the public hearing, a representative of Sunfish Commons contended <br />that the a~eement with the City required that the sewer extension would be required when a <br />frontage road was constructed. There is no frontage road associated with this project and <br />therefbre Sunfish Commons should not be responsible for this cost. At the meeting, the City <br />Attorney disagreed with this reasoning. The City Attorney has recommended that Oak Terrace <br />Estates be considered to be the sole benefited party to this improvement project, but that Sunfish- <br />Commons should be held to its responsibility to pay the cost of extending the sanitary sewer to <br />its west property line. Various legal remedies are available to the City to recover this cost. Staff <br />also recommended that prior to ordering the project and directing plans and specifications to be <br />prepared, that the mobile home park hires an engineer, at their own cost, to identify ~he necessary <br />storm sewer improvements and obtain the necessary permits from the Lower Rum River Water <br />Management Organization for that proposed system· <br /> <br />City Administrator Norman stated that the City is looldng at the possibility of the realignment of <br />Highway #10, which could impact this property. He recormnended tabling action on the issue <br />and leaves the health issue up to the State. <br /> <br />Mayor Gamec replied that even if the land is in the morator/um it may be several years before the <br />highway may be redeveloped. <br /> <br />Councilmember Cook stated that the City could consider officially mapping the property and <br />buying out the trailer park for road right of way, which is why they have a moratorium on the <br />property to discuss those issues. <br /> <br />Councilmember Strommen inquired as to what kind of delay were they talking about for <br />engineering. <br /> <br />City Engineer Jm~owski stated they would need to determine the extent of storm sewer that is <br />needed and when they have that information they would bring it forward. <br /> <br />Councilmember Strmmr~en stated that she understood that there was a moratorium on the <br />property, but there are also health concerns they have to consider. <br /> <br />Mayor Gamec inquired if they were to move forward with the project could they have an <br />agreement that the City would not be responsible for paying them for the increased value in the <br />property if the property is needed for ~rure road right of way. <br /> <br />City Council/August 12, 2003 <br /> Page 19 of 30 <br /> <br />-67- <br /> <br /> <br />
