The neighbors to the south, Joe and Rose <br />Karst at 16747 Radium St. N.W., were proposing to build a detached accessory structure in their <br />back yard and had the common property line between the two lots surveyed and staked. In the <br />process, it was determined that the Bach's attached garage was located right on the common <br />property line. To remedy the situation, City Staff approved an administrative subdivision <br />wherein the Karst's conveyed a small piece of property to the Bachs in order that their home and <br />attached garage would meet the 10 foot setback. The following items are enclosed for your <br />information: <br /> <br /> a) Site location map <br /> b) Site plan <br /> c) Easement to be vacated <br /> d) Proposed easement vacation ordinance <br /> e) New easement to be dedicated <br /> <br />Notification: <br /> <br />In accordance with State Statute, staff attempted to notify all persons owning property within 350 <br />feet of Mr. Gobernatz' property of the request for easement vacation and related public hearing. <br /> <br />Observations: <br /> <br />There is a standard 10 foot wide drainage and utility easement along both sides of the common <br />property line. As a follow up to the administrative subdivision, it is necessary to vacate this <br />existing easement and replace it with another easement along the new common property line <br />between the Bachs and the Karsts. <br /> <br />Recommendation: <br /> <br />City Staff recommends vacating the existing easement and requiring replacement of it along the <br />new common property line. <br /> <br />Council Action: <br /> <br />Motion to introduce ordinance #00-. to vacate a portion of the drainage and utility easement <br />on Lots 6 and 7, Block 4, Klemish Addition. <br /> <br />Review Checklist: <br />City Attorney <br />City Engineer <br /> <br />CC: 01/11/00 <br /> <br /> <br />
