As you know, G-B <br />Properties has entered into a Development A~eement with the City of Ramsey relating to construction of <br />improvements consisting of a Comfort Suites Motel facility upon land owned by it and described as Lot 1, <br />Block l, Riverview Estates Addition, Anoka County, Minnesota. It is contemplated that a restaurant will <br />be built on Lot 2, River'view Estates Addition adjoining this property. <br /> <br /> Section 5 of the Development A~eement requires that as shown on the proposed plat, both Lot 1 <br />and Lot 2 of the property were to receive access to U.S. Highway 10 by means of reciprocal or cross- <br />easements entered into for the benefit of both parcels, and £malizafion of the platting process has been <br />delayed as a result of those easements not having been furnished to the City of Ramsey. However, it is ' <br />now apparent, the proposed facility having been designed and built, that it would be unwise to provide for <br />the intended cross-easements because, in the likely event the parcels cease being un'der common <br />ownership, the requested Easements would promote unintended two-way traffic in the parking lot of the <br />motel facility and could lead to claims of liability and disputes over maintenance. <br /> <br /> Both parcels are adequately served by existing roads as shown on the dedicated plat; the Comfort <br />Suites facility on Lot 1 has direct highway access together with egress to Riverdale Drive, Northwest. <br />The proposed restaurant has direct access for both ingress and egress from Sunfish Lake Boulevard and <br />Riverdale Drive. Consequently, G-B Properties no longer wishes to pursue the intended easement <br />arrangement and hereby requests that Section 5 of the Development Agreement be deleted in its entirety. <br /> <br /> In making this request I have discussed the rrmtter with Dana Orosslein, General Partner of G-B <br />Properties and advised G-B Properties that the City of Ramscy would be further seeking modifications to <br /> <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
