I <br /> <br />4.10.32 <br /> <br />Abandoned and Unusable Equipment <br /> <br /> Subdivision I. A registrant who has determined to discontinue its operations <br />with respect to any equipment in any right-of-way, or segment or portion thereof, in the City <br />must either: <br /> <br />ao <br /> <br />Provide information satisfactory to the City that the registrant's obligations <br />for its equipment in the right-of-way under this Section have been lawfully <br />assumed by another registrant; or <br /> <br />S abmit to the City a proposal and instruments for ~ransferring ownership 0£ <br />it~ equipment to the City. If a registrant proceeds under this clause, the City <br />w xy, at its option: <br /> <br />Purchase this equipmc,it, or <br /> <br />Require the registra,~*~ ,~'c its own expense, to r '~u. ove it, or <br /> <br />Require the registra:x; to post an additional kond or an increased be~ <br />amount sufficient to reimburse the City fo" rza3onably anticipate~ <br />costs to be incurred ~,~. removing the equipm¢ -'. <br /> <br /> Subdo ~o Equipment of a regis?v, nt which fails to ,::o~piy with the preceding <br />paragraph and which, ~or two (2) years, remr.[:~s unused shall be deemed to be abandon¢& <br />Abandoned equipmen~ ~s deemed to be a nuis~mc~.. The City may exercise any remedies or right~' <br />it has at law or in equity, including, but not limited to: <br /> <br />a. Abating the nuisance; <br /> <br />b. Taking possession of the eq~fipment and restoring it to a useable condition; <br /> <br />do <br /> <br />Requiring removal of the equipment by the registrant or by the registrant's <br />surety; or <br /> <br />Exercising its rights pursuant to the performance and restoration bond. <br /> <br /> Subd. 3. Any registrant who has unusable equipment in any right-of-way shall <br />remove it from the right-of-way during the next scheduled excavation, unless this requirement is <br />waived by the City. <br /> <br />4.10.33 Reservation of Regulatory and Police Powers. The City by the granting of a <br />right-of-way permit, or by registering a person under this Section does not surrender or to any <br />extent lose, waive, impair, or lessen the lawful powers and rights, which it has now or may be <br />hereafter vested in the City under the constitution and statutes of the State of Minnesota, or the <br /> <br />24 <br /> <br /> <br />
