i <br /> <br />I <br />i <br />! <br />I <br />I <br />i <br />I <br /> <br /> · <br />CASE # <br /> <br /> REQUEST FOR EXTENSION TO RECORD FINAL PLATS FOR <br />RIVER PINES 3m) AND 4TM ADDITIONS; CASE OF US HOME CORPORATION <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On May 12, 1998, the Ramsey City Council granted final plat approval to Apple Ridge 2nd, 3rd, <br />4th and 5th Additions being developed by Good Value Homes. Subsequently, the property was <br />sold and US Home Corporation or Orrin Thompsbn Homes assumed the obligations of the <br />development agreements. US Home desired a plat name change 'and recorded the second phase <br />of Apple Ridge as River Pines. Accordingly the 3ra phase of what was approved as Apple Ridge <br />3rd Addition is currently in the process of being recorded as River Pines 2n°Addition. <br /> <br />Observations: <br /> <br />City Code establishes a 2 year' time frame from the date of final plat approval to record a plat at <br />the County. Therefore, recording time frame for River Pines 3rd and 4th Additions (aka Apple <br />Ridge 4th and 5th Additions) expires on May 12, 2000. The Developer has submitted a written <br />request for a one year extension to record.....River Pines 3ra and 4th Additions to provide a sufficient <br />amount of time to market the neighborhood. <br /> <br />City Code states that "the Council may extend the p~riod upon written application by the <br />subdivider and subject to all applicable performance conditions and requirements, or the Council <br />may require submission of a new application unless the Council finds that substantial activity <br />and investment has occurred in reasonable reliance on the approved application and the <br />subdivider will suffer substantial financial damage as a consequence of a requirement to submit a <br />new application." <br /> <br />For your information, copies of the approved final plats for River Pines 3rd and 4th (aka Apple <br />Ridge 4th and 5th) Additions are enclosed for your information, along with a copy. of the written <br />request for extension. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed resolution granting a one year extension to <br />record River Pines 3rd and 4t~ Additions. <br /> <br />C6uncil Action: <br /> <br />Motion to adopt Resolution #00-02- granting'a one year extension to May 12, 2001 to record <br />the final plats of River Pines 3rd and'~-t~-,~dditions. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br /> <br />CC: 02/22/00 <br /> <br />7 <br /> <br />'1,/7 <br /> <br /> <br />
