Sale Transactions Occurring between December 1 and April 1 <br /> <br />(a) <br /> <br />If the sale transaction occurs between November 1 and the <br />following April 30, and the inspection cannot be completed, the <br />transfer may occur with a stipulation that a compliance <br />inspection shall be completed by the following June 1, and a <br />certificate of compliance is completed by the following <br />September 30. <br /> <br />Prohibition Against Transfer of Property; Enforcement. No real <br />property in the City shall be transferred unless the parties to the <br />transaction have complied with the requirements of this Section. <br /> <br />Notice of Violations <br /> <br />Cause to Issue a Notice of Violation. Unresolved and either separate, <br />recurrent, or continuing violations of this Section by an applicant, <br />permittee, installer or other person, as determined by inspections, <br />inspection, or investigations shall constitute non-conformance or <br />noncompliance with this Section. <br /> <br />Serving a Notice of Violation. A notice of violation shall be served <br />by mail upon the applicant, permit, installer or other person found to <br />be in violation of this Section. <br /> <br />Contents of a Notice of Violation. A notice of violation shall contain <br />the following: <br /> <br />(a) A statement documenting the findings of fact through <br /> inspections, re-inspection or investigations; <br /> <br />(b) A list of specific violations of this Section; <br /> <br />(c) The specific requirements for correction or removal of said <br /> violations; <br /> <br />(d) A mandatory time schedule for correction, removal and <br /> compliance with this Section; and <br /> <br />(e) Specific enforcement actions that will be taken if corrective <br /> action is not completed. <br /> <br />(0 <br /> <br />In case the owner shall fail, neglect, or refuse to comply with the <br />notice to repair or rehabilitate or abate as described in the Section <br />above, the City may order the owner of the building prosecuted <br />as a violator of the provisions of this Section and may order the <br /> <br />8-20 <br /> <br /> <br />
