Goodrich, City Attorney <br /> <br />Background: <br /> <br />By Resolution #99-02-045, the Council authorized the acquisition of the 150-acre BMA property <br />by eminent domain or by direct negotiation. The City Administrator has attempted to negotiate a <br />purchase, however to date, those negotiations have not produced a successful result. Therefore <br />the Council has directed that the eminent domain legal action proceed. Since the adoption of <br />Resolution//99-02-245, the public purpose of locating the Anoka Hennepin Technical College <br />Campus on the site is no longer available to the City. In addition, because of the current status of <br />locating a transportation center for the Northstar Development Authority on the site, legal <br />counsel deems it advisable not to include this as a public purpose. These changes therefore <br />require amendment of the original resolution for this project. <br /> <br />Enclosure: <br /> <br />Proposed new resolution amending Resolution//99-02 045. <br /> <br />Recommendation: <br /> <br />Staff recommends adoption of the enclosed resolution. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #00-03- (~>~TJ which is a resolution amending resolution #99-02- 045 <br />and which new resolution authorizes the acquisition by eminent domain, of a parcel of land <br />approximately 150 acres in size lying generally north of the Burlington Northern railroad tracks <br />and west of Ramsey Boulevard. <br /> <br />Review Checklist: <br /> <br />City Administrator <br /> <br />CC: 03/14/00 <br /> <br /> <br />
