!

I
I
I
I
I
I
I
I
I

CASE # t~

REQUEST TO AMEND CONDITIONAL USE PERMIT FOR OUTDOOR
RECREATIONAL USES FOR DIAMONDS SPORTS BAR;
CASE OF DIAMONDS SPORTS BAR & GRILL, INC.
By: Megan Barnett, Community Development Assistant

Background:

The City Council granted Diamonds Sports Bar a Conditional Use Permit on March 24, 1998.
The site plan for the outdoor recreational uses included softball, volleyball and broomball. The
applieant is asking that their current conditional use permit for outdoor recreational uses be
amended to include batting cages, a splat ball course, horse shoe pits, basketball and roller
hockey in the summer and boot hockey in the winter.

The following items are enclosed for your information:

a)
b)
c)
c)
d)
e)

Site location map
...
Properties notified map
Revised site plan
Resolution #98-03-051 issued April 6, 1998
Draft Planning Commission Minutes dated March 3, 2000
Proposed Findings of fact
Proposed Amended Conditional Use Permit

Notification:

State law requires notification to properties within 350 feet of the boundaries of the subject
property. Additional neighbors along the easterly most property line of Alpaca Estates were also
notified (see attached properties notified map).

Observations:

The City has made it a practice to require conditional use permits for outdoor recreational
activities in the commercial districts. The surrounding parcels to the east and south are part of
the Mississippi West regional park, the property to the west is also zoned commercial, and the
property is bounded on the north by Hwy. #10. There is approximately 1,000 feet between the
nearest point of the subject property and the Mississippi River; however, the property is not
included in the Critical River Overlay District. There is approximately 1,100 feet between the
nearest residential neighborhood and the existing facility.
