Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to adopt
Resolution #00-03-064 authorizing reimbursement of expenditures on capital equipment
purchased prior to the receipt of certificate funds.

Motion carried. Voting Yes: Mayor Gamec, Councilrnembers Zimmerman, Hendriksen,
Anderson, and Cormolly. Voting No: None.

Councilmember Zimmerman inquired whether certificates for the entire $257,000 would be
issued at this time or only as needed. Mayor Gamec thought it was ail at once with repayment
over five years. City Administrator Norman stated he would have Finance Officer Lund address
this to the Council.

9) Northstar Corridor Rail Station

Motion by Councilmember Connolly and seconded by Councilmember Hendriksen to authorize
the City Administrator to contract with the necessary consultants to prepare information for the
Northstar Corr/dor Development Authority commuter station siting.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Connolly, Hendriksen, Anderson,
and Zimmerman. Voting No: None.

I) Authorization to Award Bid for Construction of New Fire Station

Discussion ensued regarding rebidding the project.

City Attorney Goodrich advised that the City cannot reject the bids and renegodate only with the
three lowest bidders. He asserted that the City can reject all bids, however, the Supreme Court
states it should be for compelling reasons. Mr. Goodrich noted the compelling reasons. He
stated that the City either needs to accept the lowest responsible bidder or reject all bids and open
the process to ail the bidders again.

Mayor Gamec noted that the bids were not that close that it would benefit going through the
bidding process again.

Fire Chief Kapler asserted that if the bid is awarded, staff will certainly work towards the
estimated project amount, noting that it's the consulting architect's opinion that we can achieve
that amount.

Motion by Councilmember Hendriksen and seconded by Councilmember Anderson to adopt
Resolution #00-03-065 awarding the General Contractor bid for Fire Station II to Ebert, Inc. in
the amount of$1,177,000.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, Cormolly,
and Zimmerman. Voting No: None.

City Council/March 14, 2000
