AND WAYNE JOI:INSON <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On April 11, 2000, the CitY Council reviewed a request for exception to development <br />moratorium from TSM Development, Inc. and Wayne Johnson. TSM requested the exception to <br />the moratorium in order to initiate a rezoning of Outlot A, Regency Pond from I-Industrial to <br />Urban Residential. <br /> <br />Observations: <br /> <br />The future land use map in the 12/21/99 draft of the comprehensive plan that was forwarded to <br />Metro. Council for approval identifies the subject property for development as urban/rural <br />residential transition. Urban rural residential transition density is restricted to a maximum of 3 <br />milts per acre. TSM's concept for the property identifies townhomes with a density of 15 units <br />pe,~ acre. <br /> <br />Based on the above information, the City Council directed City Staff to draft findings of fact to <br />support denial of the request for exception to moratorium. .. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Letter of request for moratorium exception. <br />Draft City Council meeting minutes dated April 11, 2000 <br />Proposed findings of fact <br /> <br />Recommendation; <br /> <br />City Staff recommends adoption of findings of fact and denial of the request for exception to <br />moratorium. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #00-04-.. adopting Findings of Fact # relating to a request for <br />exception to moratorium from TSMDevelopment, InC. and Wayne Johnson. <br /> <br />-and- <br /> <br />Motion to deny a request for exception to moratorium from TSM Development, Inc. and Wayne <br />Johnson based on the findings of fact. <br /> <br />Review Checklist: <br />City Attorney <br />City Planner <br />Commurfity Development Assistant <br /> <br />CC: 04/25/00 <br /> <br />299 <br /> <br /> <br />
