AND WAYNE JOI:INSON By: Community Development Director Sylvia Frolik Background: On April 11, 2000, the CitY Council reviewed a request for exception to development moratorium from TSM Development, Inc. and Wayne Johnson. TSM requested the exception to the moratorium in order to initiate a rezoning of Outlot A, Regency Pond from I-Industrial to Urban Residential. Observations: The future land use map in the 12/21/99 draft of the comprehensive plan that was forwarded to Metro. Council for approval identifies the subject property for development as urban/rural residential transition. Urban rural residential transition density is restricted to a maximum of 3 milts per acre. TSM's concept for the property identifies townhomes with a density of 15 units pe,~ acre. Based on the above information, the City Council directed City Staff to draft findings of fact to support denial of the request for exception to moratorium. .. Council Action: Motion to adopt Resolution #00-04-.. adopting Findings of Fact # relating to a request for exception to moratorium from TSMDevelopment, InC. and Wayne Johnson. -and- Motion to deny a request for exception to moratorium from TSM Development, Inc. and Wayne Johnson based on the findings of fact.
