I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I, <br /> I <br /> I <br /> I <br /> I <br /> <br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br />RESOLUTION #00-04- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0, RELATING TO A <br />REQUEST FOR AN EXCEPTION TO TI-[E DEVELOPMENT MORATORIUM <br />ESTABLISI-IED BY ORDINANCE 99-12 <br /> <br /> WHEREAS, on April 3, 2000, the City received a written request for an <br />exception to the development moratorium from Fafmski, Walkich & Roos, legal <br />representative for TSM Development, Inc. and Wayne L. Johnson ("Applicants"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE ,CITY COUNCIL O1' THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicar]. ts requested an exception to the development moratorium in order <br />to submit an application to the City to rezone Outlot A, Regency Pond ("Subject <br />Prop'erty"), from I~Industrial to R-3 Urban Residential. <br /> <br />2. That the stated purpose of the rezoning was to facilitate development of the Subject <br /> Property with townhomes at a proposed density of 15 units per acre. <br /> <br />The land use map in the draft comprehensive plan dated December 21, 1999 identifies <br />a change in the land use of the subject property from industrial' to urban/rural <br />residential transition at a maximum density of 3 units per acre. <br /> <br />4. That the proposed' density is inconsistent with the intent of the moratorium ordinance <br /> and the comprehensive plan amendment. <br /> <br />5. That th~ property rights will be returned at the conclusion of the moratorium. <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City <br />Council this the ___~h day of ,2000. <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />City Administrator <br /> <br />309 <br /> <br /> <br />
