Mayor Gamec asked about the title issue.

City Engineer Jankowski stated Azurite Street in front of the property is actually Outlot A. He
noted this is not a dedicated street and it is something that the City must take care of. He added
McKinley is not dedicated either. City Engineer Jankowski stated that he has contacted the
surveyor to do research and prepare the necessary documents. He noted the City owns Outlot A
and a portion of the land McKinley Street is on.

Mayor Gamec stated the City should have owned the land pr/or to paving it.

City Engineer Jankowski responded the City owned the land, but did not dedicate the right-of-
way. He stated some additional fight-of-way is needed. The current right-of-way is more than
needed for the road and Ace owns the land on which the right-of-way is needed. There is a
proposed swap.

Councilmember Hendr/ksen asked if this has been discussed with Ace Solid Waste.

Mr. Mike Berkopec, representative of Ace Solid Waste, stated it has been discussed. He noted it
makes logical sense to swap the land and clean up the issues.

Mayor Gamec asked about the ponding area dispute. He stated it appears to him to be more
aesthetically pleasing without a fence.

Mr. Berkopec identified the fenced area and the pond on a drawing. He noted the employee
parking area outside of the fence. He added it creates greenspace in front of the fence. Mr.
Berkopec stated they plan to plant trees. He noted that then the fence would be hard to see. He
added the alternate location would be in the way of the trees to be planted.

Councilmember Anderson asked how deep the pond is.

Mr. Berkopec stated eight to ten feet.

Mayor Gamec asked if there are any City requirements.

City Engineer Jankowski responded no.

Councilmember Anderson asked about safety.

Mr. Berkopec stated it is his understanding there would not be a lot of water. He noted it would
only be wet when there is a lot of rain.

Councilmember Hendriksen asked about the slope of the pond.

City Council/May 23, 2000

I
I
I
I
i
!
I
I
!
I
I
I
t
I
i
I

I
I
