CASE # ¢

ADOPT ORDINANCE AMENDING SECTION 4.80 OF THE CITY CODE, WHICH
SECTION 4.80 IS ENTITLED "STORM DRAINAGE UTILITY."

Brian E. Olson, City Engineer

Background:

On November 23, 1999, the City Council introduced an ordinance creating a storm drainage
utility. The utility was adopted on January 11, 2000. On June 27, 2000, the City Council adopted
a resolution establishing the storm drainage utility fees by amending the 2000 schedule of rates,
fees and charges. On July 11, 2000, the City Council introduced the ordinance and it has been
posted since that time at City Hall.

Observations:

The changes required of the ordinance are clerical in nature and are needed to ensure clarification
of the existing Ordinance. A new subdivision 2 was created which defines the term Residential
Equivalent Unit ("REU") and runoff from a typical one-half acre lot single-family dwelling with
a standard five-year storm is used to determine both the Residential Equivalent Factor'
("REF")and the REU. Pursuant to the discussion on July 11, 2000, a new subdivision 4 was
created in the ordinance which defines the term impervious. The timeframe for these changes to
occur are:

Introduction Date:
Posting Dates:
Adoption Date:
Publication Date:
Effective Date:

July 1 I, 2000
July 11, 2000 - July 25, 2000
July 25, 2000
July 28, 2000
August 28, 2000

Council Action:

Motion to adopt Ordinance #O0-XX - An amendment to section 4.80 of the City Code, which
section 4.80 is entitled "storm drainage utility" and which was adopted pursuant to City
Ordinance 00-01.

Reviewed by:
City Administrator
City Attorney
Director of Public Works
Finance Officer

CC: 7/25/00

Users\holson\swu[adoptordrevease.doc

-109-
