10. <br /> <br />cash payment will be required prior to the CITY releasing the Building Permit and it will <br />be utilized for drainage irnprovements within the Alpaca Estates commercial area: <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City. Engineer and shall be designed so as to deflect light away from <br />U.S. Hwy. #10 N.W. and all adjacent parcels. Bulbs emitting in excess of 3,000 lumens <br />(I 50 watts) shall be so directed that the bulb is not visible from off of the property where <br />such light source is located <br /> <br />BUILDING FACADE. The Permit-tee agrees to face the Structure with decorative <br />concrete block veneer and concrete block, integrally treated with color, and asphalt <br />shingles, in accordance with the Exterior Elevations prepared by .rim Raygor of Raygor <br />Designs and dated August 10, 2000. <br /> <br />REQUIREMENTS FOR BUILDING PERi~IIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in accordance with Item #6 of this Permit; c) provided the <br />required financial ~maarantee in accordance with Item #12 of this Permit; and d) provided <br />the City with a copy of the access permit issued by Ma/DOT. No Certificate of <br />Occupancy for the structure will be issued until: a) the Required Improvements are <br />accepted by the Ci~; and b) the landscaping maintenance guarantee has been provided <br />in accordance with Item #13 of this Development Permit. <br /> <br />I <br /> <br />I <br />I' <br />I <br />I <br />I <br />I <br />I <br /> <br />11. <br /> <br />LMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before September 1,2001. <br /> <br />-250- <br /> <br />12. <br /> <br />EscRow FOR REQUIRED. IMPROVEMENTS. In order to ensure the installation <br />of the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of six'-ty three thousand five <br />hundred Dollars and no cents ($63,500) which is 150°¼ of the City's estimated cost of the <br />Improvements. Prior to the issuance of the building permit, all financial guarantees must <br />be provided as required herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial <br />guarantee shall be returned to the Permittee and the Permit-tee shall be required to provide <br />the landscaping maintenance guarantee described in Item #13 of this Development <br />Permit. The determination of completion of the construction of the Required <br />Improvements shall be made by the City Council after consultation with the City <br />Engineer. In the event the Permittee fails to construct and install the Required <br />Improvements as required herein, the City Council may order the completion of the <br />Required Improvements with City day labor and/or by letting contracts for' said <br />completion and draw upon the escrow for payment. Only the City Council shall have the <br />authority, to direct completion of the Required Improvements and withdraw from the <br /> <br /> <br />
