CASE

AUTHORIZE A PUBLIC HEA. RING FOR THE ADOPTION OF AN ORDINANCE
AMENDING CHAPTER 6 OF THE CITY CHARTER, CREATING THE SEPA_RATE
POSITIONS OF CITY ,&DMINISTRATOR AND CITY CLERK AND ESTABLISHING A
CITY CLERK POSITION.
Klm Moore-Sykes, Assistant City Administrator

Background:

At the October 25, 1999 Council meeting, the City Council discussed restructuring the positions
of the City Administrator and City Clerk, recognizing that responsibilities and expectations have
continued to change for both the Administrator and City Clerk positions. This idea was passed
on to the Charter Commission for further study and consideration.

The Charter Commission met on July 6, 2000 and July 31, 2000 to consider that proposed
amendment to the 'City Charter..At the Commission's August 22, 2000 meeting, the Charter
Commission will review the final draft of the proposed amendments and based on Commission
action, will recommend the approval of an ordinance citing those proposed amendments to the
City Charter.

Observations:

Because an ordinance is required to amend the City Charter, the City is required to schedule a
public hearing for the adoption of a City ordinance. Pursuant to State statute, this ordinance, if
enacted, must be adopted by a unanimous vote of the City Council alter a two-week public notice
and upon the conclusion of a scheduled public hearing. The ordinance will not become effective
until 90 days alter its publication in the City's legal newspaper.

Council Action:

Direct City Staff to schedule a public hearing for the adoption of a City ordinance amending the
City Charter to reflect the separation of the positions of the City Clerk and City Administrator
and establishing a City Clerk position, alter giving notice as required by law. .

Reviewed by:

City Administrator
Assistant City Administrator
City Attorney

Distributed to:

Jo Thieling, Deputy City Clerk
Para Miller, Secretary

CC: 08/22/2000

-27~-
