(d) <br /> <br />The owner(s) shall submit to the Department an acceptable <br />replacement plan within twenty (20) days after notification by <br />the Department. The replacement plan shall identify the location <br />and design of the ISTS and a schedule for its replacement. <br />Failure to submit and execute an acceptable replacement plan is a <br />violation of this Section. <br /> <br />The Department may not require re-certification of an ISTS within two <br />(2) years of its certification date provided the system does not fail or <br />become an imminent public health threat or other cause as deemed <br />appropriate by the Department. <br /> <br />Sale or Transfer of Property <br /> <br />(a) A certificate of compliance shall be provided by the seller to the <br /> buyer at or before the closing. <br /> <br />(b) <br /> <br />The certificate of compliance shall be completed by an Inspector <br />and shall indicate that the ISTS is in compliance with MN Rules <br />Chapter 7080 as amended. <br /> <br />(c) <br /> <br />In the event that one of the exemptions listed in Subdivision <br />8.30.04 d 4 and 5 of this Section applies, the certificate must be <br />signed by both parties to the transaction. <br /> <br />(d) <br /> <br />The certificate shall be filed with the Anoka County Auditor <br />along with the Certificate of Real Estate Value. A copy of the <br />certificate of compliance shall also be filed with the Department. <br /> <br />Exempt Transactions. Thc certificate need not be completed if the <br />sale or transfer involves the following circumstances: <br /> <br />(a) The tract of land is without buildings or contains no dwellings or <br /> other buildings with plumbing fixtures. <br /> <br />Co) No Certificate of Real Estate Value need be filed with the <br /> County Auditor, as per Minnesota Statutes, Chapter 272.115. <br /> <br />(c) <br /> <br />The sale or transfer completes a contract for deed entered into <br />prior to the effective date of this ordinance. This Subsection <br />applies only to the original vendor and vendee on such a <br />contract: <br /> <br />(d) Any dwellings or other buildings with running water are <br /> connected to a municipal wastewater treatment system. <br /> <br />8-19 <br /> <br />-295- <br /> <br /> <br />
