Councilmember Look introduced the following resolution and moved for its adoption: RESOLUTION #10 -12 -263 A RESOLUTION ADOPTING FINDINGS OF FACT #0881 RELATING TO A REQUEST FROM CITY OF RAMSEY PUBLIC WORKS DEPARTMENT TO ALLOW FOR CONTINUED USE OF A TEMPORARY MODULAR OFFICE STRUCTURE ON THE PROPERTY LOCATED AT 14100 JASPAR ST NW AN INTERIM PERIOD OF TIME. City of Ramsey Public Works Department, hereinafter referred to as "Applicant," properly applied to the City of Ramsey (the "City ") for an Interim Use Permit to place a temporary modular office structure on the same parcel as their existing facility for an interim period of time on the property generally known as 14100 Jaspar St NW and legally described as follows: Lot 1, Block 1, Gateway North Industrial Park, Anoka County, MN (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Applicant appeared before the Planning Commission for a public hearing on January 5, 2005 and that the public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2) That the City Council approved the Interim Use Permit on January 25, 2005, pursuant to findings of fact favorable to the applicant. 3) That the Subject Property is approximately 4.33 acres in size and is zoned Public /Quasi- Public; the surrounding properties are zoned E -2 Employment. 4) That Section 117 -52 (Interim Use Permits) of the Ramsey City Code allows for interim uses to allow a use for a limited period of time that reasonably utilizes the property where it is not reasonable to utilize it in the manner provided by the comprehensive guide and to allow a use that is presently acceptable but that, with anticipated development will not be acceptable in the future. 5) That the Applicant submitted an application requesting an Interim Use Permit to place a temporary modular office structure on the property to utilize for offices, training and a lunch room. 6) That permanent public works campus is projected to be built at some point in the future on the Bury & Carlson site, thus alleviating the need for this temporary use. 7) That the proposed temporary modular office structure shall conform to the State Fire and Building Codes. 8) That the proposed placement of the temporary modular office structure will comply with all applicable setbacks in the Public /Quasi - Public District.
