Further discussion: Councilmember Elvig stated he did not have any issues with this, but how <br />were the upgrades being rationalized. Associate Planner Gladhill responded it depended on the <br />size of the land as well as where on the land the structure was being proposed to be placed. <br />Councilmember McGlone stated he liked the proposal, but the issue he had was the escrow. He <br />asked how the City would be certain Mr. Richter did the deal. Associate Planner Gladhill <br />responded if Mr. Richter did not comply, the City had actions that could be taken to ensure <br />compliance. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Wise, Backous, Elvig, Jeffrey, <br />McGlone, and Tossey. Voting No: None. <br />7.02: Consider Award for Contract for Engineering Services related to City Project 11- <br />21, the Signalization of Armstrong and Bunker Lakes Boulevards, and Associated <br />Infrastructure Improvements to Serve the Legacy Christian Academy Development <br />City Engineer Himmer reviewed the staff report. <br />Motion by Councilmember Elvig, seconded by Councilmember Wise, to award a contract to <br />WSB in the amount of $291,344 for City project 11 -21, the signalization of Armstrong and <br />Bunker Lake Boulevards, and associated infrastructure improvements to serve the Legacy <br />Christian Academy development contingent upon the approval of an agreement with LCA for <br />design fees up to a maximum of $106,000 which agreement is provided under a separate case. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Wise, Backous, Jeffrey, <br />McGlone, and Tossey. Voting No: None. <br />7.03: Consider agreement with Legacy Christian Academy for Reimbursement of <br />Engineering Design Fees related to City Project 11 -21; the Signalization of <br />Armstrong and Bunker Lakes Boulevard, and Associated Infrastructure <br />Improvements to Serve the Legacy Christian Academy Development <br />City Engineer Himmer reviewed the staff report. <br />City Attorney Goodrich asked if the Council wanted escrow for the money the City might spend <br />for engineering fees. <br />City Engineer Himmer noted requiring an escrow had been done before. <br />Councilmember Elvig stated it made sense to obtain an escrow to protect the City. <br />Councilmember Wise stated he would be in favor of a letter of credit. <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to approve the <br />engineering design services reimbursement agreement with LCA, subject to the review and <br />approval by the City Attorney and with a reasonable escrow. <br />City Council / January 11, 2011 <br />Page 7 of 9 <br />
