Councilmember Wise introduced the following resolution and moved for its adoption: <br />RESOLUTION #11 -01 -012 <br />RESOLUTION REQUESTING REPEAL/NO REAUTHORIZATION AND NO <br />EXTENSION OF DEADLINE FOR MISSISSIPPI RIVER CRITICAL CORRIDOR <br />AREA (MRCCA) RULEMAKING <br />WHEREAS, the Mississippi River Critical Corridor Area (MRCCA) is a 72 mile section <br />of the Mississippi extending from the cities of Dayton and Ramsey to the confluence with the St. <br />Croix River; and <br />WHEREAS, the MRCCA was established in 1976 and reaffirmed with executive order <br />79 -19; and <br />WHEREAS, the 2009 Minnesota Legislature authorized the Department of Natural <br />Resources (DNR) to establish rules for the MRCCA requiring the DNR to: <br />1. Determine the number and character of districts within each municipality; and <br />2. Establish, by rule, minimum guidelines and standards for the districts including <br />the intent of each district and identification of key resources and features to be <br />protected or enhanced. This is to be done while taking into account municipal <br />plans, policies, existing ordinances and existing conditions. <br />WHEREAS, although the proposed draft standards attempt to address many of the <br />concerns the City of Ramsey with the current rules, the proposed districts do not adequately take <br />into account existing conditions and existing plans, policies and ordinances and do not represent <br />the interests of local communities within the corridor as a whole; and <br />WHEREAS, if adopted as proposed, the rules will place additional restrictions on certain <br />public and private property owners, interfere with local land use and zoning activities, and <br />impact the ability to operate and maintain park and roadways systems. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. The M- innesota Legislature should repeal State Statute Chapter 172, Article 2, Section 5 <br />(e) and Section 27 and leave in place existing standards and guidelines. <br />2. If requested, the Minnesota Legislature should not reauthorize State Statute Chapter 172, <br />Article 2, Section 5 (e) and Section 27. <br />3. If requested, the Minnesota Legislature should not extend the deadline for MRCCA <br />rulemaking authority under State Stature Chapter 172, Article 2, Section 5 (e) and <br />Section 27. <br />
