I I I I I I I '1 I ,I I I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #00-10- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR PRIVATE DOG KENNEL TO MAINTAIN MORE 'THAN TWO DOGS ON A PARCEL OF LAND. WHEREAS, the Ramsey City Council adopted Resolution #00-10- adopting Findings of Fact # .. to maintain more than two (2) dogs on a parcel and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On ., a Conditional Use Permit ("Permit") was issued by the City of Ramsey ("City") to Amy Ross ("Permittee") for a private dog kennel to maintain more than two adult dogs on the property generally known as 81.00 154~ Avenue and legally described as follows: Lot 4, Block I2, Whispering Pines Estates, Anoka County, Minnesota ("Subject Property"). This Permit is issued pursuant .to Section 9.03.04 of the Ramsey .City Code. this Permit are as follows: The conditions of 1. This Permit shall remain in'effect so long as the terms contained herein are complied With and Amy Ross is the fee title owner of the Subject Property. 2. This Permit shall allow for the maintenance of a maximum of six (6) adult dogs on the Subject Property. An adult dog is de£med as any dog over three (3) months of age. The Permit-tee agrees that no more than four (4) dogs can be kenneled outside at any one time, except that all six (6) dogs may be exercised outside under the 'Permittee's' control during the hours of 7:00am- 8:00pm daily. 4. The Permittee agrees that all slx (6) dogs Mil be kenneled indoors by 8:00pm every evening. Upon confirmation of complaints regarding dogs disturbing the peace, the City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog Regulations), Subd. 19 (Dogs Disturbing the Peace), of the Ramsey City Code~ stated as follows: "It shall be unlawful for any person to own, keep, have in possession, or harbor any dog which howls, yelps, or barks to the reasonable annoyance of another person or persons. Any person violating this section, who upon first requested by a Police Officer or Animal Control Officer to stop or prevent the annoyance, and refuses to comply with the request will be -251-
