The following is a description of the proposed changes to the tower
regulations:

· Restrict commercial towers on residential property to parcels at least 10 acres in size
that are located in an area to be identified as a Tower Overlay District (same area as
that depicted in the draft comprehensive plan as the Rural Preserve Area);
· .Restrict all other towers' in the Residential district, generally, to church, park,
government, school, utility, and.institutional sites at least 10 acres in size.
· Establish a tower setback from adjacent residential dwellings equal to 1.5 times the
height of the tower.
· Increasing the tower height in residential zones fi:om 75 to 120 feet (designed for at
least 3 antennas).
· Co-location radius was increased from ½ mile to 1 mile.

Observations:

Subsequent to Council's introduction oft he ordinance on October 24, City Staff determined that
some minor text changes were necessary in the ordinance. We needed to clarify that 10 acre
parcel sizes were not required for the placement of antennas on existing towers or structures, or
for parks adjacent to industrial or commercial uses. The changes to the ordinance since
introduction are shown as bold italics on the enclosed draft.

Recommendation:

In accordance with the City Charter, the ordinance is eligible for adoption at this time.

Council Action:

Motion by and seconded by
City regulations for commercial towers.

to adopt Ordinance #00-

to amend the

Roll Call Vote:

Councilmember Zimmerman
Councilmember Cormolly
Councilmember Hendriksen
Councilmember Anderson
Mayor Gamec

Review Checklist:
City Attorney

Copy To:
Theresa Greenfield, MFRA

CC: 11/14/00

-261-
