RESOLUTION #00-09- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT' FOR A HOME OCCUPATION BASED .ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR A MASSAGE THERAPY IN THE SINGLE FAMILY RESIDENTIAL DISTRICT r WHEREAS, the Ramsey City Council adopted Resolution #00-11- adopting Findings of Fact #for this use and herein approves the Conditional Use Permit for a Home Occupation subject to the following conditions. NOW THEREFORE BE IT. RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On a Conditional Use Permit ("Permit") was issued by the City of Ramsey ("City") to Cathleen Artman ("Permit Holder") for a home occupation to establish a massage therapy in the dwelling on the property generally known as 14651 Neon Street NW and legally described as follows: Lot 10, Block 5, Chestnut Ridge 2"d, Anoka County, Minnesota (" Subject Property") This permit is issued pursuant to Section 9.03.04 and 9.11.04 of the Ramsey City Code. The conditions of this permit are as follows: o That this resolution shall allow for the establishment and operation of a massage therapy service on the Subject Property. This Permit is perpetual in its duration as long as the terms imposed herein are complied with. The area devoted to the home occupation shall not' exceed twenty percent' (20%) of the total floor area of the private dwelling. That the Permittee will not operate an adult use massage parlor that is defined as follows in City Code: "A massage parlor or health club which restricts minors by reason of age, and which provides the services of massage, if such service is distin~ou, ished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas." The Permit-tee shall restrict business hours to 9:00am - 9:00pm, Monday through Saturday. -115-
