I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br /> <br />CASE # <br /> <br />INTRODUCE ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT <br />IN NORTHFORK HIGHLANDS ADDITION; CASE OF NORTH FORK, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In 1995, the Ramsey City Council approved reducing the area of the drainage and utility <br />easement in the rear yards of'Lots 10 and 11, Block 1, Nortkfork Highlands Addition. The <br />extraneous easements were acquired with the first phase of Northfork without regard for <br />elevations. By the time Northfork Highlands was platted, it was determined that large portions <br />of this easement were not necessary and approved for vacating. The ordinance was never <br />properly recorded. <br /> <br />In 1996, there was an administrative subdivision to realign the common property lines between <br />Lots 11, 12 and 13 of Block 1 in Northfork Highlands Addition. This realignment of property <br />lines changed the legal description of Lot 11. ~ <br /> <br />When North Fork attempted to do some follow up and record the easement vacation of 1995, the <br />ordinance was rejected by the County because the legal description was not current with the <br />administrative subdivision that took place in ! 996. <br /> <br />City Council adopted a resolution in May of 2000 authorizing staff to correct :the legal <br />description in the 1995 easement vacation ordinance. This was done and there was still an error <br />in the legal description and the County rejected it again. In addition, Staff and the applicant also <br />determined that in conjunction with the 1996 administrative subdivision, the standard drainage <br />and utility easements along the common property lines of Lots 11, 12 and 13 were not vacated <br />and replaced along the new common property lines. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject properties were <br />notified of the hearing. <br /> <br />Observations: <br /> <br />Staff has determined that it would be appropriate to rescind the previous Ordinance and <br />Resolution and initiate a new case and ordinance to vacate and replace drainage and utility <br />easements on Lots 10, 11, 12 and 13 of Block 1, Northfork Highlands.
