-264- <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />1. City Code Compliance. That the DEVELOPER Mit develop the Plat in <br />accordance with the applicable provisions of City Code, Section 9.50, entitled <br />"Subdivision". <br />2. Conformance with Plan. The Plat shall be developed pursuant to the final plat <br />for Holiday Acres consisting of one sheet prepared by Pioneer Engineering. <br /> <br />3. Compliance with City Code. That the recitals above and the applicable. <br />provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY as amended to date hereof, are incorporated herein by reference. <br /> <br />4. Stag..e I Improvements. Stage I Impro.vements shall consist of sanitary sewer, <br />municipal water, storm sewer and. the extension of the raised median on Xkimo Street. <br />The installation of these Improvements shall be established as a term of the Development <br />Permit entered into with the CITY for the development of the property subsequent to <br />obtaining site plan approval from the City Council. <br /> <br />5. Access From Trunk Highway #47. The DEVELOPER herein agree that right- <br />of-access along T.H. #47 adjacent to Lot 1 and Lot 2, Block 1, Holiday Acres shall be <br />dedicated to the State of Minnesota. <br /> <br />6. Pedestrian/Bicyclist Path. The DEVELOPER agrees to construct, in <br />accordance with City standards, an eight (8) foot wide bituminous pedestrian/bicyclist <br />path, not to exceed 5% in grade nor 2% cross sectional, parallel to T.H. #47. Due to the <br />additional fight-of-way for State Highway 47 that was obtained from this property, the <br />majority of the trail near Lot .1 will need to be built in' the State right-of-way. The <br />DEVELOPER agrees to get ali 'necessary permits to construct and maintain the path and <br />any landscaping installed as part of the development prior to work within the State right- <br />of-way. The DEVELOPER shall, also provide approved turf establishment in <br />conjunction with the path construction within the subject Plat similar to that which is <br />approved for the building site. The remainder of the path to be constructed upon the Plat <br />shall be constructed within a twenty (20) foot easement that has been deeded to the CITY <br />in recordable form. The DEVELOPER agrees to construct the portion of the path located <br />on Lot 2 at the time the lot is developed. The construction plans for said path are subject <br />to the prior approval of the City Engineer. <br /> <br />o <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Six Hundred Dollars and <br />-Fifty Eight ($3,658.00) per commercial acre. The amount of Stormwater <br />Management Fee due on Lot 1 is Five Thousand One Hundred Twenty One <br />Dollars and Twenty Cents ($5,121.20) (1.40 acres x $365.8/acre).
