CASE <br /> <br />REQUEST FOR A VARIANCE TO ACCESSORY STRUCTURE SETBACK <br />REQUIREMENTS; CASE OF ROGER LAVOIE <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Roger Lavoie is requesting a variance to construct an accessory <br />building closer to the front property line than the principal structure located at 6200 160~' Lane <br />NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />The parcel is approximately 7.5 acres in size, and the house is located at the rear of the property. <br />The applicant estimates that there is approximately 6 1/2 acres or 500 feet in front of the house to <br />the property line. Mr. Lavoie is proposing to construct a garage that will be built even with the <br />edge of the existing garage and will be 45' feet w/de (going towards the property line). The <br />proposed garage will be approximately 455 feet from the property line. <br /> <br />The site plan and pictures submitted reveal that the property is significantly covered by mature <br />tree growth, the house is located at the very rear of the 7.5 acre parcel, a mound system is located <br />at the rear of the principal dwelling, and the weI1 system and some wetlands exist to the southeast <br />of the main dwelling. These features prohibit construction of a garage in the side or rear yard. It <br />is Staff's opinion, that mature tree growth and the location of the home will cause no adverse <br />impact to the neighbor's view of the streetscape bythe construction of the proposed garage. <br /> <br />The existing attached garage is 704 square feet and the applicant plans to construct a 1,440 <br />square foot building for a total accessory building square footage of 2, I44. The applicant is <br />allowed a total of 4,064 square feet for accessory buildings. <br /> <br />The Board of Adjustment recently granted a similar variance to Mr. and Mrs. Kucala. <br /> <br />Pll <br /> <br /> <br />
