CASE #1: <br /> <br />REQUEST FOR A VARIANCE TO MINIMUM LOT SIZE IN THE RU~4~L <br />SERVICE AREA; CASE OF DAVID AND GtL4~CE IBACH <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />David and Grace Ibach reside at 7630 181" Avenue N.W. The adjacent parcel to the <br />north has a driveway that has been partially located on the Ibach parcel for approximately <br />30 years. The Ibachs are interested in correcting the problem and conveying part of their <br />property to the new owner of the property to the north, Brian Vanderlee. <br /> <br />The Ibachs would like to convey a portion of their property to Mr. Vanderlee via an <br />Administrative Subdivision: An Admnistrative Subdivision, wkich is approved at the <br />City Staff level, is a conveyance of property between adjacent property owners by metes <br />and bounds description rather than by platting. However, City Staff cannot approve an <br />Administrative Subdivision that will render one of the lots substandard. <br /> <br />Observations: <br /> <br />Mr. Ibach's property is located in the Rural Service Area and the minimum lot size is 10 <br />acres. Mr. Ibach's property is I 0 acres in size. In order to correct the erroneous driveway <br />problem, Mr. Ibach would like to convey 1.4 acres o£his property to Mr. Vanderlee. This <br />will result in a new lot size of 8.6 acres on Mr. Ibach's property. Therefore, the <br />administrative subdivision cannot be processed unless a variance to minimum lot size is <br />granted. <br /> <br />If granted, the variance will not create any new lots and compliance with the density <br />restriction of 4 lots in 40 acres will be maintained. The City has on at least one other <br />occasion, granted a variance to the minimum lot size in the Rural Service Area. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Property Survey <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property, owners within 350 feet of the <br />subj ecl property of the request for variance and public hearing. <br /> <br /> <br />
