During the Board's discussion on February 1, it was noted that the common property line
between Mr. Boyum's lots was realigned in 1998. A legal question arose regarding whether that
action then changed the "lot of record" date from the 1940's to 1998. Staff discussed this issue
with City Attorney William Goodrich and his opinion is that a lot line adjustment does not
change the "lot of record" date.

Board Action:

Motion to adopt Resolution #00-03- adopting Findings of Fact #~ relating to Harold
Boyum's request for a variance to Section 9.21.07 of the Ramsey City Code regarding lot area,
lot width and structure setback from the Mississippi River.

Motion to approve Mr. Harold Boyum's request for a variance on Lot 30, Bowers Mississippi
Acres based on the findings of fact and adopt Resolution #00-02- declaring terms of same.

-or-

Motion to deny Mr. Harold Boyum's request for a variance on Lot 30, Bowers Mississippi Acres
based on the fmdings of fact.

Review Checklist:
Building Official
City Attorney

BoA: 03/06/00
