Since the adoption of the new rules in 1985, several homes have been developed on <br />Bowers Drive that are substandard by today's standards, but most of them were not duo- <br />ownership situations. Likewise, several homes have been constructed along the river <br />with setbacks from the ordinary high water mark in line with adjacent structure setbacks <br />versus today's 200 foot setback. In 1997, the Board granted a variance in a Case nearly <br />identical to Mr. Boyum's case. Currently, there are about six (6) cases of duo-ownership <br />lots on Bowers Drive. <br /> <br />The Scenic River and the Shoreland rules provide for a setback from the river similar to <br />that pattern established by adjacent structures. Staff doesn't know if that same provision <br />was excluded from the Critical River regs inadvertently or intentionally. <br /> <br />Recommendation: <br /> <br />Staff recommends that a variance to lot width, lot area and structure setback be granted to <br />Lot 30 in order that it may be developed with a dwelling unit. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #00-02- adopting Findings of Fact # relating to <br />Harold Boyum's request for a variance to Section 9.21.07 of the Ramsey City Code <br />regarding lot area, lot width and structure setback from the Mississippi River. <br /> <br />Motion to approve/deny Mr. Harold Boyum's request for a variance on Lot 30, Bowers <br />Mississippi Acres based on the findings of fact and adopt Resolution #00-02- <br />declaring terms of same. <br /> <br />Review Checklist: <br />City Engineer <br />City Attorney <br />DNR <br /> <br />BoA: 02/01/00 <br /> <br /> <br />
