Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #00-02-000 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO HAROLD <br />BOYUM'S REQUEST FOR A VARIANCE TO LOT WIDTH, LOT AREA, AND <br />STRUCTURE SETBACK FROM THE MISSISSIPPI RIVER <br /> <br /> WHEREAS, Harold Boym, hereinafter referred to as "Applicant", has properly applied <br />for a Board of Adjustment variance from Section 9.21.07 of the Ramsey City Code to develop <br />the following legally described property as a buildable lot with a variance to lot width and area, <br />and structure setback from the Mississippi River: <br /> <br />Lot 30, Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on February 1, 2000 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Residential and is approximately .8 acres in <br /> size. <br /> <br />3. That the surrounding parcels are also zoned R-1 Rural Residential. <br /> <br />4. That the Subject Property is located in the Scenic and Critical River Overlay Districts. <br /> <br />That Section 9.21.07, Subd. 1.a of the Ramsey City Code requires a minimum lot width of <br />200 feet, lot area of 2.5 acres, and a structure setback of 35 feet from bluff or 200 feet from <br />ordinary high water mark, whichever is greater. <br /> <br />That Section 9.21.07, subd. 2.c.1 (Critical River Overlay District/Existing Lots of Record) of <br />the Ramsey City Code indicates that only "lots of record in the office of the County Register <br />of Deeds (or Registrar of Titles) prior to July 29, 1985 (date of enactment) which do not meet <br />the requirements of 9.21.07, subd. 1, may be allowed as building sites provided: <br /> <br />a) such use is permitted in the zoning district <br />b) the lot is in separate ownership from abutting lands, and <br />c) all other sanitary and dimensional requirements of 9.21 Environmental <br /> Protection are complied with insofar as practical." <br /> <br /> <br />
