CASE #1

RECEIVE DEVELOPERS COMMENT ON
PROPOSED TRAIL/SIDEWALK ORDINANCE
By: Mark Boos, Parks/Utilities Supervisor

Background:

The purpose of this case is to invite public comment on the proposed sidewalk/trail ordinance
that has been discussed by the Commission for the past few months. (As you'll recall, at
January's regular meeting, the Commission recommended approval of a sidewalk/trail resolution.
Staff is recommending that this matter be addressed by ordinance, as it will then be referred to in
the subdivision ordinance of City Code.) On Tuesday, February 1, 2000, the Planning
Commission recommended the language below:
~_~i~'All subdivisions within the urban service area shall have a minimum eight-foot (8') wide
ituminous or concrete '~" sidewalk paralleling each street to provide for effective snow
emoval and safe two-way pedestrian traffic. The only urban subdivision streets that may not be
required to have these trails are residential cul-de-sacs with no probability as a through street.

The trail shall be constructed as a Stage I improvement. The cost will be borne by the developer
and not eligible for credit against park and trail dedication fees. The design must meet current
standards of the City, comply with the ADA act and be shown on the preliminary plat for
approval."

This is different from what the Park and Recreation Commission reviewed only in that it states
that cul-de-sacs will not receive the sidewalks, regardless of the number of units on that street. It
is important to note that the above draft language is permissive relating to cul-de-sacs. For
instance, if there was a destination on that dead-end street, (i.e., trail, park, retail center, or
connection to another cul-de-sac) then the City may require a walkway on this street too.
Enclosed for your information, is a letter sent to developers and those urban residents requesting
to be kept informed on trail issues.

The following is a tentative schedule for this proposed ordinance amendment:

· Februa _ry 10, 2000 - Regular Park and Recreation Commission meeting
Commission hosts informational meeting to receive comments from developers and others on
the proposed ordinance.
· March 6, 2000- Regular Planning Commission meeting
Commission holds public hearing.
· March 14, 2000- City Council meeting
Council considers ordinance for introduction (first reading).
· March 28, 2000- City Council meeting
Ordinance adoption.
