City Engineer Jankowski stated the water system is not bound by the Metropolitan Council since
it is the City's own water utility. However, it would have an impact if the question is the demand
coming from an area anticipated for expansion.

Councilmember Anderson asked what will happen if there are two dry summers.

Director of Public Works/Fire Chief Kapler stated that with the current storage facility, twice last
summer, the City ran to almost zero pressure with the demand~om the existing homes and
businesses. He noted that the City continues to grow and from a Public Works staff standpoint,
this project is needed to provide proper storage today, not even considering future growth.

Councilmember HendlSksen asked how long the design phase will take and if the contract
requires the City to pay the $101,000 if the project stops after the design phase.

City Engineer Jankowski stated the design phase would be ready for bidding by April with the
contract awarded in May. He noted the design phase is $23,000 and the City would not be
obligated to pay the remainder of the contract if the project stops after the design phase. He
noted that the City could draft the contract 'to indicate the City can stop the project at any point.

City Attorney Goodrich agreed that he could draft a contract to do all or part of the work.

Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adopt
Resolution #00~01-026 and direct the City Attorney to draft the contract language to allow the
City to do all or part of the project.

Further discussion: Councilmember Anderson asked if the City is able to consider a contract that
may not be the lowest bid. City Attorney Goodrich stated this is outside of the competitive
bidding process, meaning the City can do so and is not legally required to even obtain the second
quote.

Motion carried. Voting Yes: Mayor Pro tern Zimmerman, Councilmembers Hendriksen,
Connolly, and Anderson. Voting No: None. Absent: Mayor Gamec.

Case #10: December Report from Public Works Committee

1) Update on Apple Ridge Drainage

City Attorney Goodrich stated the City did enter into an agreement with Apple Ridge so this is a
moot point.

City Council/January 25, 2000

I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
