I was <br />asked to review this project to determine if the wetland excavation was compliant with the <br />Wetland Conservation Act of 1991 (WCA) as of November, 2001, The wetlands on the site are <br />Type 2 and 7 (,saturated wetlands with grasses and trees) based on the 'National Wetland <br />Inventory CNWI) maps. These types of wetlands can be excavated under the WCA without a <br />permit if certain requirements are met. Thus, I usually recommend that a permit is received prior <br />to exca~'ation to ensure compliance. Also, some excavations will need a Section 404 permit from <br />the US Army Corps of Engineers (USCOE). <br /> <br />One of the conditions of the conditional use permit (CUP) issued on September 23, 1997 was to <br />obtain ~he necessary permits from regulatory agencies for the placement of fill within wetlands. I <br />have not found any evidence of permits obtained for this site. Also, there is evidence that <br />wetland fill was placed within the wetland for the haul road and a new ditch connection has been <br />established with County Ditch $1; which may cause drainage. In my opinion, wetland permits <br />were needed for the past activity on the site and permits will be needed for proposed activity in <br />the future. Also, the site currently has a Cease and Desist from the Department of Natural <br />Resources (DNR) because no permits have been issued. <br /> <br /> My recommendation is that a Technical Evaluation Panel made up ora representative of the <br /> Lower Rum River Water Management Organization (.LRRWMO), the Anoka Conservation <br /> District, the Board of Water and Soil Resources (BWSR), the USCOE and other interested parties <br /> should be put together as soon as possible to review this site and make recommendations to the <br /> LP,.RWMO. Also, in my opinion, a new CUP should not be issued until wetland permits are <br /> obtained from the proper regulatory agencies. <br /> <br />Thank you for the opportunity to comment. <br /> <br />Beck>, L.
