Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #01-t 1- RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, the Ramsey City Council adopted Resolution No. 01-11- adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF t;L~kMSEY, ANOIC~ COUNTY, STATE OF MINNESOTA, as follows: On November 27, 2001, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to John Enstrom ("Permit Holder") for grading operations on that property identified on the Enstrom Property and Project Site Plan dated November 3, 2001, prepared by City Staff, which site is a portion of the following legally described property: All that part of the Northwest Quarter of Section 5, Township 32, Range 25, Anoka County, Minnesota. EXCEPT All that part of the North Half of the Northwest Quarter of Section 5, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at a point on the North line of said Northwest Quarter distant 978.0 feet East from the Northwest comer of said Section 5; thence East along said North line a distance of 700 feet; thence South at right angles to said North line a distance of 1245 feet; thence West at right angles to last course a distance of 700 feet; thence North at right angles to last course a distance of 1245 feet to point of commencement. EXCEPT The West 300 feet of the North 1452.0 feet of the West Half of the Northwest Quarter of Section 5, Township 32, Range 25, Anoka County, Minnesota. EXCEPT All that part of the Northwest Quarter of the Northwest Quarter of Section 5, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at a point on the North line of said Northwest Quarter distant 978.0 feet East from the Northwest comer of said Section 5; thence West along said North line a distance of 163 feet; thence South at right angles to said North line a distance of 1245 feet; thence East at right angles to last course a distance of t63 feet; thence North at right angles to last course a distance of 1245 feet to the point of commencement. Containing 4.65 acres, more or less.
