Commissioner Jensen inquired if other cities place time limits on interim use permits. <br /> <br />Planning Consultant Scalzo replied yes. <br /> <br />Commissioner Jensen inquired if it would be possible to include a specific time requirement. <br /> <br />Planning Consultant Scalzo replied that as the ordinance is currently proposed the time limit <br />would be at the discretion of the Planning Commission and City Council. <br /> <br />Commissioner Johnson requested that under Subdivision 3, item #6, that the wording "by <br />agreement with the owner", be removed since the applicant always has the right to withdraw <br />their application. <br /> <br />Consensus of the Commission was to remove the wording "by agreement with the owner". <br /> <br />Commissioner Nixt inquired in regards to Subdivision 4, item #2, questioning if it was the intent <br />to automatically terminate the permit or given an opportunity to correct the situation. <br /> <br />Planning Consultant Scalzo replied that in other cities the permit is typically terminated. <br /> <br />Commissioner Nixt stated that from a practical standpoint the applicant would be notified of the <br />violation and given the opportunity to correct the situation within a certain time frame. He <br />suggested changing the wording under Subdivision 4, item #2, to read "Upon violation and <br />failure to cure...". <br /> <br />Commissioner Johnson suggested having the Council and City Attorney review the wording in <br />Subdivision #4 to determine if it is appropriate and place a time frame for correcting the <br />violation. <br /> <br />Commissioner Nixt suggested leaving the time frame up to the Council. <br /> <br />Commissioner Johnson suggested the wording to Subdivision 4, item #2, to read "A violation of <br />conditions under which the permit was issued; or which continues for a period of time identified <br />in the notice of violation; or". <br /> <br />Commissioner Dempsey suggested adding item #7 under Subdivision #4 to read "Applicant will <br />proceed in a timely manner to provide for the construction of permanent structures, where <br />necessary, that will result in proper utilization of the land on which any temporary structure is <br />located. <br /> <br />Motion by Commissioner johnson, seconded by Commissioner Jensen, to recommend that City <br />Council adopt an Ordinance adding SectiOn 9.03.04A titled "Interim Use Permits" with changes <br />made to Subdivision 3/item #6, Subdivision 4/item #3, and the addition of Subdivision 4/item <br />#7. <br /> <br />Planning Commission/December 20, 1999 <br /> Page 6 of 12 <br /> <br /> <br />
