Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-03-051 <br /> <br />A RESOLUTION APPROVI2NG THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR ESTABLISHMENT OF ACCESSORY OUTDOOR RECREATIONAL USES TO A <br />RESTAURANT AND BAR BASED UPON FINDINGS OF FACT #0452 AND <br />DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Diamonds Spqrts Bar & Grill, Inc. (Permittee) has properly applied for a <br />conditional use permit (CUP) on the property l~gally described as follows: <br /> <br />Outlot C, TOOTH ACRES, Anoka County, Minnesota; or upon recording the plat, <br />Lot 1, Block 1, The Diamonds; Anoka County, Minnesota <br />(the "Subject Prope~y'..'); and .. '.'. ;..-. <br /> <br /> WHEREAS, the Planning Commission met on March 12, 1998, conducted a public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />I) Term: This permit shall be perpetual in its duration so long as the conditions imposed <br /> herein are complied with. <br /> <br />2) <br /> <br />3) <br /> <br />Site Development: The development and operation of the outdoor recreational facilities <br />shall be specifically limited to that described in the Permittee's site plan consisting of one <br />sheet prepared by Clark Engineering Corporati6n dated April 28, 1998. <br /> <br />Off-Street Parking: The permittee shall provide sufficient off-street parking in <br />accordance with the approved site plan and regular occurrence of on-street parking shall <br />constitute a violation of this Permit. Because of the proximity to the Mississippi River, <br />the Permittee shall also be required to provide pretreatment of nm-off from the parking <br />areas. <br /> <br />4) <br /> <br />Hours of Operation: All softball and volleyball play shall cease by 10:00 p.m. and the <br />outdoor recreational area shall be cleared of all activity by I0:30 p.m. This restriction <br />shall also apply to any lighting used in this recreational area of the site. <br /> <br />5) <br /> <br />Restroom Facilities: The use of portable restroom facilities shall be screened ~om the <br />general public. -The screening plan is subject to the approval of the City. <br /> <br />6) <br /> <br />Control of Operations: The permittee shall be responsible for fencing in the entire <br />outdoor recreational activity area. <br /> <br /> <br />
