CONSENT AGENDA <br /> <br />There were no items on the Consent Agenda. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #I: <br /> <br />Ordinance to Amend Chapter 9 (Zoning and Subdivision of Land) Section <br />9.03.04 and Add Section 9.03.04A of the Ramsey City Code <br /> <br /> Planning Consultant Scalzo stated that Ramsey City Code presently does not have language to <br /> support and process the applications of interim use permits. In the past, the City of Ramsey has <br /> accepted applications as interim use permits and processed them as conditional use permits with <br /> a time limit or sunset provision attached. This is no longer an acceptable practice. The only <br />. permit that can legally be attached a time limit or "sunset provision" is an interim-use permit. <br /> Conditional use permits are land use permits that run with the land. They cannot be <br /> automatically revoked when a particular, applicant sells, or a specific time period elapses. For <br /> this reason, the second part. of the amendment includes the deletion of the sentence "in addition, <br /> one of the conditions may include a specified time limit for the conditional use." from Section <br /> 9.03.04 Subdivision 7. <br /> <br />Councilmember Hendriksen inquired if Subdivision 3 item #6 should read "Will be subject <br />to .... ", rather than "Will be subjected to, .... ". <br /> <br />Consensus of the Council was to change to change the wording to "subject". <br /> <br />Planning Consultant Scalzo reviewed the wording that was added by the Planning Commission <br />to Subdivision 4 item #2. <br /> <br />Councilmember Hendriksen requested that the terminology be worded by the City Attorney. <br /> <br />Planning Consultant Scalzo stated that the Planning Commission added item #7 under <br />Subdivision #3 that read "Applicant will proceed in a timely matter to provide for the <br />construction of permanent structures, where necessary, that will result in proper utilization of the <br />land on which any temporary structure is located." <br /> <br />Councilmember Hendriksen stated that if the City is going to grant an interim use permit, it <br />should be an interim use for what the final use will be and should be included in the application <br />process. A timeline should be requested and articulated and if the applicant does not comply <br />then it would be grounds for termination. <br /> <br />Planning Consultant Scalzo explained that the Planning Commission was concerned with the <br />repetition of granting interim-use permits without moving forward with any permanent project. <br /> <br />City CounciI/December 21, 1999 <br /> Page 3 of 15 <br /> <br /> <br />
