9.02 Definitions <br /> <br /> Interim Use - Temporary use of property until a particular date, until the <br />occurrence of a particular event or until zoning regulations no longer permit it <br /> <br />9.03.04A INTERIM USE <br /> <br />Subdivision 1. Purpose. The purpose and intent of allowing interim uses is (1) to allow <br />a reasonable use for a limited period of time that is not provided in the City's zoning <br />regulations; and (2) to allow a use that is presently acceptable, but that with anticipated <br />development will not be acceptable in the future <br /> <br />Subdivision 2. Application, Public Hearing, Notice and Procedure. The application, <br />public hearing, public notice and procedure requirements for interim use permits shall be <br />the same as those for Conditional Use Permits as provided in Section 9.03.04. <br /> <br />Subdivision 3. Standards. The Planning Commission shall recommend an interim use <br />permit and the Council shall issue such interim use permits only if it finds that: <br /> <br />1. The proposed interim use meets the standards ora conditional use permit set for <br /> in Section 9.03.04 of the City Code. <br />2. The proposed interim use conforms to the zoning regulations, such as setbacks, <br /> heights, and parking. <br />3. The proposed interim use will terminate upon a date or'event that can be <br /> identified with certainty, with a maximum duration of 5 years from the date of <br /> approval, unless otherwise approved by the City Council. <br />4. The proposed interim use will not impose, by agreement, additional costs on the <br /> public if it is necessary for the public to take the property in the furore <br />5. The proposed interim use will be subject to, by agreement with the owner, any <br /> conditions that the City Council has deemed appropriate for permission of the use, <br /> including a condition that the owner will provide an appropriate f'maneial surety <br /> to cover the cost of removing the interim use and any interim structures upon the <br /> expiration of the interim use permit. <br />6. That if the proposed interim use is intended to become a permanent use on the <br /> site, a reasonable time schedule for such transition acceptable to the City has been <br /> presented by the owner. <br />7. That the proposed interim use wiI1 not result in adverse effects on the public <br /> health, safety and welfare of the city or (he citizen therein. <br /> <br />Subdivision 4. Termination. An interim use permit shall terminate upon (he occurrence <br />of any of the following events; whichever first occurs: <br />1. The date stated in the permit; or <br />2. Violation of conditions under which (he permit was issued. <br />3. Revocation resulting from a cessation of the Interim Use for 30 consecutive days. <br /> <br /> <br />
