In no case shall the slope of the working <br />face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When <br />grading operations are anticipated to be discontinued for an interval greater than one <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br />No grading operation shall be conducted closer than 30 feet to the right of way line of any <br />existing or platted street, road or right of way. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by the City in the amount of Five Thousand Dollars ($5,000.00) shall be <br />deposited with the City. This financial guarantee may be used by the City to pay for the <br />cost and expense of repairing any public right of ways or regrading and stabilizing eroded <br />areas due to the grading operation, pay for any cost associated in administering the <br />requirements of this Chapter of the City Code, and to pay for any restoration of the <br />worksite not properly restored upon completion. <br /> <br />The Permittee shall implement sediment and erosion control practices. No grading <br />activity shall occur within twenty-five (25) feet of a property line unless silt fence is <br />placed along the property line to prevent sediment from washing onto the adjoining <br />property. Any erosion which causes gullies of greater than one (1) foot within twenty- <br />five (25) feet of a property line shall be regraded within forty-eight (48) hours of the <br />precipitation event that caused the erosion. <br /> <br />There shall be no stockpiling of graded materials, other than the topsoil on a temporary <br />basis on the Subject property.. Topsoil stockpiles shall not exceed 900 cubic yards in total <br />nor six (6) feet in height. '~ <br /> <br />The Permittee shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br />person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of 10 <br />days prior notice to the City by registered mail of termination, cancellation or amendment <br />of the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this <br />item is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated May, <br />16, 1995 prepared by Ulteig Engineers, Inc., revision dated November 3, 1999. The <br />proposed area to be graded is roughly two acres in size. Excavation of the entire area <br />shall be permitted. Continuation of grading shall require finished grade areas to be <br />restored with six (6) inches of topsoil, seed and disc anchored mulch. <br /> <br /> <br />
