CASE # 1 <br /> <br />REQUEST TO AMEND CONDITIONAL USE PERMIT FOR OUTDOOR <br />RECREATIONAL USES FOR DIAMONDS SPORTS BAR; <br /> CASE OF DIAMONDS SPORTS BAR & GRILL, INC. <br /> By: Megan Barnett, Community Development Assistant <br /> <br />Background: <br /> <br />The City Council granted Diamonds Sports Bar a Conditional Use Permit on March 24, 1998. <br />The site plan for the outdoor recreational uses included softball, volleyball and broomball. The <br />applicant is asking that their current conditional use permit for outdoor recreational uses be <br />amended to include batting cages, a splat bail course, horse shoe pits, basketball and roller <br />hockey in the summer and boot hockey in the winter. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Properties notified map <br />Revised site plan <br />Resolution/t98-03-051 issued April 6, 1998 <br />Proposed Findings of fact <br />Proposed Amended Conditional Use Permit <br /> <br />Notification: <br /> <br />State law requires notification to properties within 350 feet of the boundaries of the subject <br />property. Additional neighbors along the easterly most property line of Alpaca Estates were also <br />notified (see attached properties notified map). <br /> <br />Observations: <br /> <br />The City has made it a practice to require conditional use permits for outdoor recreational <br />activities in the commercial districts. The surrounding parcels to the east and south are part of <br />the Mississippi West regional park, the property to the west is also zoned commercial, and the <br />property is bounded on the north by Hwy. #10. There is approximately 1,000 feet between the <br />nearest point of the subject property and the Mississippi River; however, the property is not <br />included in the Critical River Overlay District. There is approximately 1,100 feet between the <br />nearest residential neighborhood and the existing facility. <br /> <br />The applicant is proposing to incorporate two batting cages, one would be located between the <br />existing ball fields #2 & #3 and the second cagewould be between fields #2 & #1. A splat ball <br />course would be located in the south east comer right behind Field #1. The horse shoe pit is <br />proposed to be located behind Field #3 to the east of the existing pond and to the west of the <br /> <br /> <br />
