Councilmember Anderson asked if there is a potential for a "monster garage" and very small
house.

Community Development Director Frolik stated the garage size could be restricted to a certain
percentage of the house but after Staff research, it was determined that type of restriction would
be difficult to clearly draft.

Councilmember Connolly asked if this was an experiment that has proven to not be successful.

Community Development Director Frolik stated that is correct.

Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to introduce
the ordinance to amend Chapter 9 (Zoning and Subdivision of Land) to eliminate size restrictions
on attached garages.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson,
and Zimmerman. Voting No: None. Absent: None.

!
Case #6 Adopt Ordinance Establishing Interim' Uses

City Attorney Goodrich noted on Page 138, Subdivision 3, the language has been amended to be
more readable and to change the word "shall" to the word "may."

Motion by Councilmember Connolly and seconded by Councilmember Zimmerman to adopt
Ordinance #00-04 to amend Chapter 9 of the City Code to establish Interim Uses.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Connolly, Zimmerman,
Anderson, and Hendriksen. Voting No: None. Absent: None.

Case #7: Adopt Right-Of-Way Ordinance

City Engineer Jankowski explained that on January 11, 2000, an ordinance regulating the use of
right-of-way within the City was introduced. At that meeting, representatives for Connexus
Energy requested an opportunity to meet with City Staff to review a number of concerns with
this model ordinance. Following review of a number of proposed changes suggested by
Connexus and review by the City Engineer, the City Attorney, and ultimately, the Public Works
Committee, the amended ordinance was introduced on March 21, 2000.

City Attorney Goodrich stated that all of the changes were approved with the exception of a
question raised about the definition of "excavate."

Mayor Gamec stated the question was the depth of excavation.

City Council/April 11, 2000
