City Attorney Goodrich clarified that the project cannot proceed until the wetland issue is <br />satisfactorily resolved. <br /> <br />The Council concurred and asked for a report on what is found on the site. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />approve the request for a conditional use permit from Ace Solid Waste, based on the findings of <br />fact as revised, and adopt Resolution #00-04-104 declaring terms of same. <br /> <br />Motion carded. Voting Yes: Mayor Garnet, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Connolly. Voting No: None. Absent: None. <br /> <br />Case #5: Request for Site Plan Review; Ace Solid Waste <br /> <br />Community Development Director Frolik explained the City has received a request for site plan <br />review from Ace Solid Waste. The plan proposes to construct an office/shop facility with a truck <br />terminal and transfer station. The site is generally located west of Azurite Street and north of <br />McKinley Street. She advised the proposal meets Code requirements and the Planning <br />Commission had previously recommended site plan' api0roval for the office/truck terminal <br />contingent upon compliance with City Staff Review Lettel~ dated March 2, 2000. However, they <br />have not reviewed the transfer site issues. She suggested that component be brought back to the <br />Planning Commission and the Council consider the site plan review of Phase I. <br /> <br />Councilmember Hendriksen asked if it would cause a problem if site plan approval is not <br />considered tonight. <br /> <br />Mr. Berkopec stated they were expecting approval of the site plan for the truck terminal and <br />office facility so they can proceed. He stated they would not object to the site plan for the <br />transfer station being referred back to the Planning Commission. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to grant site <br />plan approval to Ace Solid Waste for the Office/Truck Terminal contingent upon compliance <br />with the City Staff Review Letter dated March 2, 2000. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Mayor Gamec declared a recess at 9:20 p.m. The meeting was reconvened at 9:30 p.m. <br /> <br />Case #6: <br /> <br />Request to Rezone Property from B-1 and B-2 Business to Planned Unit <br />Development; Case of Mallard Ponds <br /> <br />Community Development Director Frolik explained that the Council has previously discussed <br />Chris Bulow's request for rezoning of property proposed to be platted as Mallard Ponds to <br /> <br />City Council/April 25, 2000 <br /> Page 18 of 29 <br /> <br /> <br />
