Wayne Johnson, Zimmerman, stated he is not a petitioner on this parcel and wants the record to
correctly indicate he is out of the title on this property. He clarified that he is not part of this
application or property.

Councilmember Hendriksen stated he wants to assure the record is correct since the statement
was made that the request was denied at the last meeting but, in fact, it was tabled for preparation
of findings of fact.

City Attorney Goodrich stated that is correct and was assumed for denial since he was directed to
prepare negative findings of fact.

Ms. Adair Zentner clarified that they represent TSM Development (not Wayne L. Johnson) and
stated she understands the matter was tabled to prepare negative findings of fact which would
result in denial of their request.

Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to adopt
Resolution #00-04-105 adopting Findings of Fact #0519 relating to a request for exception to
moratorium from TSM Development, Inc.

Motion carried. Voting Yes: Mayor Gamec, CdUncilmembers Hendriksen, Zimmerman,
Anderson, and Connolly. Voting No: None. Absent: None.

Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to deny a
request for exception to the moratorium from TSM Development, Inc. based on the findings of
fact.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman,
Anderson, and Connolly. Voting No: None. Absent: None.

Case #9:

Introduce Ordinance for Land Exchange Between City of Ramsey and Lord
of Life Church

City Attorney Goodrich explained that in order to facilitate a swap of land between the City of
Ramsey and Lord of Life Church, the City must convey its parcel to the Lord of Life Church and
in order to do that, it must adopt an ordinance pursuant to Charter requirements. The property
known as the Elke Property, 14640 St. Francis Boulevard, has a lengthy metes and bounds
description. It is that part of the E ½ of the NW ¼ of Section 25, PIN 25-32-25-24-0005. He
noted the proposed ordinance is presented for the Council's consideration to allow this
conveyance.

Motion by Councilmember Anderson and seconded by Councilmember Connolly to introduce
the ordinance providing for the sale of PIN 25-32-25-24-0005, known as the Elke Property,
14640 St. Francis Boulevard NW, Ramsey, Minnesota.

City Council/April 25, 2000
