Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #00-05- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO ESTABLISH WAREHOUSE OPERATIONS AS AN ACCESSORY USE TO AN <br />OFFICE BUILDING IN THE B-3 HIGHWAY BUSINESS BASED UPON FINDINGS OF <br />FACT #05 AND DECLARING TERMS OF SAME' <br /> <br /> WltEREAS, Jerry Thell Construction CPermittee) has properly applied for a conditional <br />use permit (CUP) on the property legally described as follows: <br /> <br />Lot 4, Block 5, Alpaca Estates, Anoka County, Minnesota <br /> <br />(the Subject Property); and <br /> <br /> WHEREAS, the Planning Commission met on May 2, 2000, conducted a public hearing <br />and recommended City Council approval of the request./ <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />Term: This permit is contingent upon the Permittee obtaining site plan approval as <br />established in Section 9.03.06 (Site Plan Review) of the Ramsey City Code and shall be <br />perpetual in its duration so long as the conditions imposed herein are complied with. <br /> <br />2) <br /> <br />Site Development: The development and operation of the office/warehouse shall be <br />specifically limited to that described in the Permittee's approved Site Plan consisting of <br />__. sheet(s) prepared by dated , and approved Building <br />Elevations prepared by dated ,2000. <br /> <br />3) Outside Storage: Outside storage of equipment and supplies shall be prohibited. <br /> <br />4) <br /> <br />Off-Street Parking: Off-street parking of currently licensed and roadworthy autos and <br />trucks shall be permitted; all other equipment and supplies related to all business <br />operations on the Subject Property shall be stored indoors. <br /> <br />5) <br /> <br />Severability: If any provision of this CUP shall be declared void or unenforceable, the <br />other provision shall not be affected but shall remain in full force and effect. <br /> <br />6) <br /> <br />Modification: This CUP shall not be considered modified, altered, changed or amended <br />in any respect unless in writing and signed by the City and the Permittee. <br /> <br />7) <br /> <br />Amendment, Suspension or Revocation of CUP' The violation of any of the material <br />terms of this CUP is grounds for suspension or revocation hereof, consistent with <br />applicable law. Furthermore, the City specifically reserves the right to amend, suspend or <br /> <br /> <br />
