P.W. CASE #: <br /> <br />UPDATE ON MISSISSIPPI SUB-DRAINAGE DISTRICT NO. 1 <br /> By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />As you may recall, the City Council ordered Improvement Project #99-67 on April 11, <br />2000 and authorized the offers below for obtaining necessary drainage and utility <br />easements on May 9, 2000. These offers have been in the hands of the property owners <br />since June 1, 2000. I have received only one written response to the offer from ICO <br />(Parcel 1) which counters the City's offer of $555 with $1,280. I have received an oral <br />agreement for the settlement on Parcel 2 with Sheltered Venture. Parcel 3, Lowell <br />Zitzloff has verbally indicated the he believes an easement already exists as a condition <br />of the site plan approval for his development on Parcel 3. I have also been advised <br />verbally by the owner of Parcel 4 that he would not accept except the easement offer. I <br />have had no responses from the remaining parcels. <br /> <br />I will be contacting these remaining property owners by phone early next week to <br />ascertain whether they have an interest in accepting on making a counter offer for <br />settlement of the easement offers. <br /> <br />At this point, if the City proceeds on a quick take acquisitions of these parcels, the City <br />could obtain title to these parcels in November. Since it would appear that this property <br />can only be acquired through emminent domain, it is staff's opinion that a certified <br />appraiser be retained for preparing appraisals in anticipation of a contested court action. <br /> <br />Recommendation: <br /> <br />Staff recommends that formal appraisals are obtained on Parcels 4, 5, 6, and 7 and that <br />emminent domain papers be filed by the City Attorney with the court. <br /> <br />Committee Action: <br /> <br />Motion to recommend that formal appraisals are obtained on Parcels 4, 5, 6, and 7 and <br />that emminent domain papers be filed by the City Attorney with the court. <br /> <br />Review by: <br />City Administrator <br />City Attorney <br />Public Works Director <br /> <br />P.W. 07/18/00 <br /> <br /> <br />
